These Terms and Conditions ("Terms") govern your use of the Trust Health & Safety website (trusths.co.za) and any purchase you make from us. By placing an order or using this website, you agree to these Terms in full. If you do not agree, please do not use our website.

These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act, No. 68 of 2008 (CPA), the Electronic Communications and Transactions Act, No. 25 of 2002 (ECTA), and the Protection of Personal Information Act, No. 4 of 2013 (POPIA).

2. Eligibility

You must be 18 years or older to place an order on this website. By placing an order, you confirm that you are at least 18 years of age and that you have legal capacity to enter into a binding agreement.

3. Ordering

An order placed on our website constitutes an offer by you to purchase goods at the stated price. We reserve the right to accept or decline any order. We accept your order when we send you an order confirmation email. We reserve the right to refuse service to anyone for any lawful reason.

You are responsible for ensuring that all order details — including delivery address, product specifications, sizes, and customisation information — are correct before submitting. We are not liable for errors you make when placing an order.

4. Pricing and VAT

All prices displayed on the website are in South African Rand (ZAR) and are inclusive of VAT at the current applicable rate (15%), unless explicitly marked otherwise. A full VAT breakdown — showing the VAT-exclusive subtotal, the VAT amount, and the VAT-inclusive total — is shown in your cart and at checkout. Prices are subject to change without notice. The price charged will be the price displayed at the time your order is confirmed.

In the event of a pricing error, we reserve the right to cancel your order and issue a full refund before dispatch. We will notify you promptly if this occurs.

5. Payment

Payment is required in full before goods are dispatched (except for approved trade account holders).

We accept the following payment methods:

All card and EFT payments are processed securely by PayFast (Pty) Ltd. We do not store your card details. You are subject to PayFast's terms and conditions when using their payment gateway.

6. Availability

While we endeavour to maintain accurate stock information, availability is not guaranteed. If an item you have ordered is out of stock or discontinued after your order is placed, we will contact you within 2 business days to offer a substitute, a backorder, or a full refund.

7. Product descriptions and compliance

We take reasonable care to ensure product descriptions, specifications, and images are accurate. However, minor variations in colour, finish, or presentation may occur. Images are for illustrative purposes only.

Where products carry SABS or SANS compliance markings, this reflects the manufacturer's certification at time of listing. Customers are responsible for verifying that products meet the specific regulatory requirements of their application or industry. Compliance documentation (test reports, certificates) is available on request for most lines — email orders@trusths.co.za with the SKU.

To the maximum extent permitted by South African law, Trust Health & Safety's total liability to you for any claim arising from your use of this website or purchase of goods shall not exceed the value of the specific order giving rise to the claim.

We are not liable for indirect, consequential, or special losses, including loss of profit, loss of data, or business interruption, except where such liability cannot be excluded under the CPA or other applicable law.

This website is provided "as is". While we take reasonable steps to ensure it is accurate and available, we do not warrant that the website will be uninterrupted, error-free, or free of viruses. You access and use the website at your own risk.

15. AI shopping assistant

This website offers an automated chat assistant powered by artificial intelligence ("the assistant"). By using the assistant you accept the following:

15.1 Automated answers. The assistant's replies are generated automatically. Although it draws on our own product records, its answers may be incomplete, inaccurate or out of date, and it can misunderstand a question. Answers are provided for general product information only.

15.2 No professional, safety or compliance advice. The assistant does not provide professional advice of any kind and cannot advise on whether a product is adequate, suitable or compliant for your workplace, task or legal obligations. Selection of personal protective equipment must be based on the product's official datasheet and your own (or your employer's) risk assessment and safety officer. Nothing the assistant says constitutes a representation that a product meets any standard, regulation or requirement.

15.3 Prices, stock and delivery are indicative. Prices, stock levels and delivery estimates mentioned in chat are automated, indicative and provided for convenience. The price and availability displayed at checkout, and the delivery cost confirmed when your order is processed, are the figures that apply to a purchase.

15.4 No authority to contract. The assistant cannot conclude agreements on our behalf, reserve or hold stock, agree discounts, or vary these Terms. Only written confirmation from our team can do so.

15.5 Conversations are stored. Chat conversations, including any photos you upload, are stored and may be reviewed by our staff to answer your enquiry and to improve the service. Please do not share sensitive personal information in chat. Message content is processed by third-party AI service providers in order to generate replies.

15.6 Fair use and availability. Use of the assistant is subject to reasonable usage limits. We may suspend, limit or withdraw the assistant at any time without notice.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or a transaction concluded through this website shall be referred first to the National Consumer Commission or an accredited Consumer Court as required by the CPA, or resolved by mediation before litigation is commenced. The Western Cape High Court shall have jurisdiction for any formal legal proceedings.

We may update these Terms from time to time. Continued use of this website after changes are posted constitutes your acceptance of the revised Terms. We recommend checking this page periodically.
